1. GENERAL DISPOSITIONS

1.1 www.midar.ro is the official website of S.C. SC MIDAR GROUP S.R.L., with headquarters on STR. 1 DECEMBRIE 1918, Nr.61, in Rosu / Chiajna, Jud. ILFOV, registered at the Trade Register under no. J23 / 526/2004, Unique Registration Code: RO 14085473, hereinafter referred to as “Midar Group”.

1.2 The site aims to provide, free of charge, all those interested in Midar Group brands and products, information about them. The site is operated and managed by Midar Group.

1.3 At the moment when there will be campaigns promoted by Midar Group, the interested persons will be asked to consult the regulations related to them, from a dedicated section.

1.4 Access to this site as well as its use are allowed only in accordance with the terms and conditions below, as well as with the applicable legal provisions.

1.5 If you do not agree with the conditions of use of the site, which also involves the processing of personal data by Midar Group, please do not use this site.

 

2. RESPONSIBILITY

2.1 Midar Group cannot be held liable in any way to any customer who uses the site or the content, other than within the limits of the articles that constitute the Terms and Conditions.

 

3. APPLICABLE LAW - JURISDICTION

3.1 This contract is subject to Romanian law. Any disputes between Midar Group and customers / buyers will be settled amicably or, if this is not possible, the disputes will be resolved by the competent courts at the headquarters of Midar Group.

3.2 If any of the above clauses is found null and void, regardless of the cause, this clause will not affect the validity of the other clauses.

 

4. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

4.1 The content of the site including, but not limited to logos, stylized representations, still images, dynamic images, text and / or multimedia content, are the exclusive property of Midar Group, to which all rights obtained in this regard are reserved. directly or indirectly (through licenses for use and / or publication). These elements are protected by relevant legislation on the observance of copyright and related rights, trademarks, designs and patents as well as patents and utility models.

4.2 Any reproduction or representation, even partial, by any means, made without the written, prior and express consent of Midar Group is prohibited and illegal. Failure to comply with this prohibition constitutes a counterfeit or an act of unfair competition that engages the civil and criminal liability of its author.

5. FINAL PROVISIONS

5.1 We make every effort to ensure that we protect and respect the confidentiality of personal data by implementing appropriate technical and organizational measures, in accordance with the requirements of Regulation no. 679/2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (General Regulation on data protection), Law no. 190/2018 on the implementation of the General Regulation on Data Protection and good practices in data processing.

5.4 Considering the provisions of Regulation (EU) no. 524/2013 on the online settlement of consumer disputes and amendment of Regulation (EC) no. 2006/2004 and Directive 2009/22 / EC, Midar group offers the client the possibility to opt for the out-of-court settlement of possible disputes, by using the European online dispute resolution platform (SOL platform), a digital tool created by the European Commission for to facilitate the independent, impartial, transparent, effective, expeditious and equitable settlement, by extrajudicial means, of disputes concerning contractual obligations arising out of contracts for the sale or provision of online services between a consumer residing in the Union and a trader established in Union.
